1. Agreement to Terms By accessing the website at www.rxclearpath.com or using the services provided by Clear RX Path ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you are prohibited from using our site and services.

2. Nature of Services Clear RX Path is an independent prescription advocacy organization. We assist uninsured and underinsured individuals in applying for and managing enrollment in pharmaceutical Patient Assistance Programs (PAPs).

  • We are not a pharmacy, a medical provider, or an insurance company.

  • We do not prescribe medications, dispense medications, or provide medical advice.

  • Approval for assistance programs is strictly determined by the respective pharmaceutical manufacturers based on their specific eligibility criteria. Clear RX Path does not guarantee approval for any medication.

3. Communications and SMS Policy By providing your phone number and submitting our eligibility or contact forms, you provide express consent to be contacted by Clear RX Path via automated phone calls, pre-recorded voice messages, and SMS text messages regarding your account, application status, or marketing promotions.

  • Consent to receive text messages is not a condition of purchasing any service.

  • Message and data rates may apply.

  • Message frequency varies.

  • Opt-Out: You may opt out of receiving text messages at any time by replying STOP to any message. For assistance, reply HELP.

4. User Responsibilities To utilize our advocacy services, you agree to provide completely accurate, current, and truthful personal, medical, and financial information. Failure to provide accurate information may result in the rejection of your manufacturer applications or the termination of our services. You are responsible for promptly notifying us of any changes to your address, income, or prescribed medications.

5. Fees and Cancellations Clear RX Path charges a flat monthly administrative fee for our advocacy and management services. You may cancel your service with us at any time by contacting our support team. Upon cancellation, we will cease managing your PAP enrollments, which may result in a lapse in your medication deliveries from the manufacturer.

6. Limitation of Liability In no event shall Clear RX Path, its directors, employees, or affiliates be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our website or services, including but not limited to delays in manufacturer approvals, denied applications, or delayed medication shipments.
